The Nasarawa State Government and the State House of Assembly have filed a motion before the High Court of Nasarawa State sitting in Lafia, seeking a stay of execution of the ruling delivered on December 11, 2025, in the suit instituted by the suspended Chairman of Lafia Local Government Council, Hon. Mohammed Haliru Arabo.
The motion on notice was brought pursuant to Section 36 of the 1999 Constitution of the Federal Republic of Nigeria and Order 41 of the High Court of Nasarawa State (Civil Procedure) Rules, 2010.
The defendants/applicants include the Nasarawa State House of Assembly, the Speaker of the House, the Nasarawa State Government, and the Attorney General of the State.
In the application, the defendants are urging the court to stay the execution of the ruling delivered by Justice Aisha Mohammed Usman in Suit No. NSD/LF/150/2025, which ordered the reinstatement of Hon. Arabo, pending the hearing and determination of a motion filed by the House of Assembly seeking to set aside the ruling.
The House of Assembly has also filed a separate motion to set aside the ruling, arguing that the act sought to be restrained had already been completed and that the court lacked the jurisdiction to determine a substantive matter through an interlocutory application.
Additionally, the Assembly filed another motion requesting the court to restrain the Inspector General of Police, the Commissioner of Police, and the Chief Registrar of the High Court of Nasarawa State from taking any steps to enforce the ruling pending the determination of the defendants’ applications.
The motions are expected to be heard on a date to be fixed by the court.
